These general terms and conditions form an integral part of the contract concluded between the travel agency Ride Goričko, Peter Gomboc s.p. (hereinafter referred to as ‘the travel agency Ride Goričko’) or an authorised travel agency and the customer who decides to purchase a specific holiday package or other services offered by the travel agency Ride Goričko or another authorised travel agency.
These General Terms and Conditions apply to holiday packages and other services organised or offered by the travel agency Ride Goričko, and to holiday packages or other services provided by other tour operators or service providers, which the travel agency Ride Goričko offers on its website www.ridegoricko.com. These General Terms and Conditions shall be deemed to apply unless otherwise specified in these General Terms and Conditions or in the contract relating to holiday packages or other services provided by other tour operators or other service providers.
The tour operator is the travel agency named as the tour operator in the travel contract, which guarantees that the published programme will be carried out in accordance with the terms of the package. In the event that the special terms and conditions of business or an individual programme stipulate otherwise with regard to any point in these general terms and conditions and instructions, the provision set out in the programme or contract shall apply.
In the case of sales by telephone or via the internet, the customer is deemed to have accepted the provisions of these general terms and conditions at the time they booked the holiday package by telephone or via the internet. The customer may familiarise themselves with the terms and conditions and instructions on the website www.ridegoricko.com or on any other website where the travel agency Ride Goričko, as a provider of its own or third-party holiday packages, offers its services online, where they are specifically marked and generally accessible.
A ‘booker’ is any person who has made a valid booking or purchased and paid for a holiday package or other service from the travel agency Ride Goričko, and to whom these General Terms and Conditions apply.
The customer may book a holiday package or activity offered by the Ride Goričko travel agency as part of its range of services, via its website, through an authorised agency or remotely. Upon booking, the Ride Goričko travel agency and the customer enter into a contract for travel or the provision of an activity, which also serves as a booking confirmation and contains either details of the customer’s holiday package or activities, or refers to the package programme where this information is set out. Upon booking, the customer is obliged to provide all the details and submit the documents required by the travel programme or activity programme, and to pay any registration fee, booking charges and costs associated with preparing a quotation for the sale of travel packages.
The client is required to provide true and completely correct information. In the event that the client fails to provide correct information at the time of booking, they shall be liable for all costs or consequences arising from the incorrect information.
The customer’s booking is binding. The customer may only cancel it in accordance with the provisions regarding the customer’s cancellation of the trip (Clause 9 of these General Terms and Conditions). The contract is deemed to come into force upon signature by the customer, or upon payment by the customer, regardless of whether the contract has been signed or not. In addition to an explicit written booking or a signed contract, any order submitted verbally or in writing that contains the first name and surname of the customer and the other participants, a credit card number or details of another payment method, payment of the booking fee or part thereof, payment of booking charges, an implied act indicating that the customer has made a binding booking, or a booking containing any of the aforementioned details.
The participant acknowledges that taking part in the activities involves a certain degree of risk. There is a possibility of visiting places where political, cultural and geographical factors pose a greater danger than is typically encountered in everyday life. The Ride Goričko travel agency checks information with the Ministry of Foreign Affairs of the Republic of Slovenia. However, the client is also responsible for familiarising themselves with important information regarding the trip. The client confirms that they agree that they have decided to undertake the trip or activity in light of this information and accept the personal risk associated with such a trip or activity.
The customer also confirms and clearly understands that certain risks or dangers may arise during the trip or activity. The customer agrees to assume all risks associated with the trip or activity, and agrees that the travel agency Ride Goričko or any member of the travel agency Ride Goričko shall not be liable for death, bodily injury, illness or any loss or damage to the client’s property during the trip or activity, regardless of the cause.
The customer agrees not to claim compensation for any injuries arising, in whole or in part, from their participation in the trip or activity.
The client is aware that the nature of this type of travel or activity may require flexibility and allows the use of alternatives. The itinerary presented is for informational purposes and may be changed or adapted depending on current circumstances and events. The Ride Goričko travel agency endeavours to ensure that the itinerary runs as described, but reserves the right to make changes, for example due to the weather, local circumstances and events beyond the travel agency's control.
Our group excursions are led by a guide from the Ride Goričko travel agency or by a guide from one of the agency’s contractual partners. All decisions made by the guides are final in any circumstances that could affect the safety or well-being of any person taking part in the tour or activity. If you fail to comply with the guide’s decisions or disrupt the well-being of the group, the guide may order you to leave the trip immediately, without any entitlement to a refund. In such circumstances, where a participant is removed from the trip, the travel agency Ride Goričko accepts no responsibility for their return transport to the final destination or for any costs that may be incurred as a result. We may also decide not to take such a participant on any subsequent booked tours. Participants must comply with the laws, customs and regulations regarding drugs in the country visited at all times. Participants also agree to act in accordance with the guidelines of the Ride Goričko travel agency.
It is the participant's responsibility to be at the designated location at the agreed time. Ride Goričko travel agency is not liable for any delays upon arrival. Our obligations begin only at the agreed time at the designated meeting point.
The terms and conditions of the Ride Goričko travel agency also contain important instructions:
DECLARATION OF LIABILITY AND JOINT LIABILITY IN SPORTING ACTIVITIES, with which the client shall familiarise themselves before the start of each sporting activity, and by signing it, confirms that they agree and irrevocably consent to, and undertake to comply with, the rules and instructions of the Ride Goričko travel agency and its staff whilst taking part in the sporting activities. Regardless of whether the client is an individual participant, a company, an institution, an association or an agency, all participants who will take part in the specific sporting activities must read and sign the instructions. If one or more individuals refuse to sign or do not agree with the instructions, they may not take part in the activities organised by the Ride Goričko travel agency, regardless of whether the activity has been paid for or otherwise settled in advance. Similarly, anyone who does not comply with all the requirements set out in the instructions may not take part in the activities.
SAFETY OF PARTICIPANTS IN ACTIVITIES – a brief overview of the guidelines on liability and shared responsibility in sporting activities, programmes and packages, which every participant in sporting activities, programmes or packages is required to sign:
Restrictions on participation in activities:
The date of payment is considered to be the day when the client makes the payment to the bank account of the Ride Goričko travel agency. The booking is confirmed when the Ride Goričko travel agency has the funds in its bank account.
Upon booking, the customer shall pay a booking fee amounting to 30 % of the package price, or the amount stated in the travel programme, as well as any booking charges. The customer shall pay the remaining amount at least 8 days before the start of the trip, or as specified in the itinerary.
If the client or authorised agency fails to pay the remaining part of the contractual obligation within the scheduled period, it shall be deemed that they have cancelled the travel contract, and the provisions regarding the client's cancellation of the travel contract from point 9 of these general terms and conditions and instructions shall apply mutatis mutandis.
Timely and correctly paid registration fee and reservation costs guarantee the client, under the conditions specified in these general terms and conditions and instructions or under the conditions specified in the special business conditions or programme, the possibility of participation or a vacant place on an individual tour arrangement. Upon departure, the client is obliged to present the tour leader with a document confirming payment for the arrangement (order form/referral form/voucher); otherwise, the tour leader shall not accept the client on the trip.
The client may pay in cash or with another designated payment method. In accordance with the terms of non-cash transactions of financial institutions, in the event of non-cash payment (bank transfer) for a tourist package or other service provided by the Ride Goričko travel agency, cash will not be refunded under any circumstances, and the client may request a credit note if they are entitled to one.
Special payment terms are set out in the quotation and/or the Price List for services.
The prices of the tourist package or activity are in euros (€) and are determined by the programme and are valid from the date the programme is published.
The price of the activity, programmes or packages includes all services specified in the quotation/contract that was sent to the client and which the client confirmed by confirming the reservation.
Additional services are all services that are ordered in addition to the pre-arranged activity, programme, package or compensation. Additional services are not part of the offer/contract, and are therefore paid separately in the form of a surcharge. Payment for additional services shall be made after the service has been rendered within 7 days of the travel agency Ride Goričko issuing an invoice to the client. These include, for example, food, drinks, and additional individual or group activities. In some cases, food and/or drinks may already be part of the offer – in these cases, no surcharge applies for food and drinks, unless the client has ordered additional food and drinks that were not part of the previously agreed offer/contract. Additional services must be confirmed by the client in writing and before arrival, though the client may also order additional services during the course of the programme, package or activity itself.
Other services are services that are not part of the programme, but are strictly necessary for the implementation of the programme, e.g. accommodation and food for instructors on multi-day programmes, instructors' mileage to a specific location where the activity, programme or package is carried out, transport of participants to the location if ordered by the client, etc. Other services shall also be paid for by the client if the implementation of the programme requires the temporary relocation of the team or part of the team of the Ride Goričko travel agency to the location where the activity, programme or package is carried out.
Hidden costs are fees that agencies and companies usually charge without prior warning. These include various admission fees, tips, unannounced visits to various shops selling local products, etc. The Ride Goričko travel agency does not resort to hidden costs and never charges hidden costs.
All prices are stated in Euros (EUR). VAT is charged in accordance with applicable legislation. Where the special scheme for travel agencies applies, VAT is charged in accordance with the provisions of the Value Added Tax Act governing the special scheme for travel agencies.
In addition to the base price of the tourist package, the client is also obliged to pay all mandatory surcharges (such as visas and the like) and any other potential surcharges. The final price of the tourist package or activity forms an integral part of the travel contract or the contract for the performance of the activity.
The organiser of the trip or activity is entitled to increase the price no later than 20 days before the start of the trip in the event of changes in the exchange rate of the contractual (agreed) currency, an increase in transport costs, including fuel costs, or an increase in fees for certain services (at airports, ports, etc.) that affect the price of the trip or activity. The price increase shall be calculated using the same percentage as the increase in the aforementioned elements of the calculation. The travel contractor or the customer has the right to terminate the contract for the organisation of the trip if the price increase exceeds 8 % of the basic price of the package. In this case, they are entitled to a refund of the amount paid, without any entitlement to compensation for damages or any costs relating to visas, insurance, vaccinations and similar expenses.
The organiser shall notify the client of any potential change in the price of the holiday.
The travel agency Ride Goričko may recommend in the programme that the client pays at the time of booking for services (additional or optional excursions, sports equipment rental, etc.) that will be provided at the destination. In this case, the travel agency Ride Goričko does not act as an organiser, but solely as an intermediary. In such cases, the client must submit any complaints exclusively to the service provider or supplier at the destination.
The travel agency Ride Goričko may specify the price of the package in the programme, provided it expressly states that the price may be reduced or increased if a certain number of clients register or if other precisely defined conditions occur. Such a provision under no circumstances guarantees that the conditions for the reduction or increase of the package price will occur. The client cannot withdraw from the contract on the grounds that the conditions for a potential price reduction have not been met.
Any potential discounts and benefits are always mutually exclusive and cannot be combined. If multiple discounts and/or benefits are applicable, the subscriber shall choose the discount or benefit that suits them best and for which they meet the conditions.
After the booking has been confirmed, the client may subsequently change or replace the client's name or the number of participants. If the client wishes to increase the number, this must be confirmed in writing to the travel agency Ride Goričko. In the case of a smaller number of participants for the activity, programme or package than previously agreed, the written cancellation conditions under point 9 shall apply. If the travel agency Ride Goričko has granted the client a group discount on the price, this shall be forfeited.
Unless otherwise specified in the programme, the tour price includes transport (air travel – economy class), hotel and catering services specified in the travel programme, and tour organisation.
Unless otherwise specified in the programme, the prices for each holiday package are per person for accommodation in double rooms.
Special or additional services are those services that are generally not included in the basic tour price (single room, special dietary requirements, additional excursions, etc.).
If special or additional services are listed in the offer for an individual arrangement, the client shall submit requests for these services upon booking, and shall pay for them in addition to the base price of the arrangement. The published prices for additional or special services shall apply solely in the event that these services are ordered and paid for at the time of booking and payment for the base arrangement at the point of booking.
The price of the trip or activity does not include tourist or any other insurance. The Ride Goričko travel agency strongly recommends that the client arranges health or personal accident insurance before the trip or activity. The insurance should provide cover for accidents, death, medical expenses and emergency repatriation. We also strongly recommend personal liability insurance, and insurance for the loss of luggage and personal belongings. We recommend that you read the general terms and conditions of your insurance policy carefully before departure.
The customer may withdraw from the package travel contract or the execution of the activity at any time before the start of the tourist arrangement.
The client has the right to withdraw from the package travel contract or the contract for the performance of activities via the website www.ridegoricko.com or the email address hello@ridegoricko.com. In the event that the client withdraws from the travel contract, the Ride Goričko travel agency may require the client to pay a suitable and justified cancellation fee (cancellation costs).
The amount of the cancellation fee depends on the remaining time until the start of the tourist package. If the client cancels the travel contract, the Ride Goričko travel agency reserves the right to retain any booking fees.
For package travel contracts or activity arrangements concluded via the website www.ridegoricko.com or the email address hello@ridegoricko.com, the customer has the right to withdraw from the contract within 14 days without stating any reasons and without paying a cancellation fee. In doing so, the customer is obliged to reimburse the Ride Goričko travel agency for the administrative and other actual costs incurred as a result (e.g. reservation costs, visa costs, insurance, airport taxes, etc.).
The amount of the cancellation fee depends on the time remaining until the start of the package holiday and is as follows:
up to 30 days before the start date of the service – 20 % of the package price,
from 29 to 22 days before the start date of the service – 30 % of the package price,
from 21 to 15 days before the start date of the service – 40 % of the package price,
from 14 to 8 days before the start date of the service – 60 % of the package price,
from 7 days up to and including the day of departure or the start of the service – 100 % of the package price,
Non-attendance without cancellation of the contract – 100 % of the package price.
During a trip or activity, the client may terminate the trip or activity of their own accord and with a written statement of termination. If the client terminates the trip during the journey, upon their return they have no right to a refund of costs or the purchase price, neither partially nor in full. If the client voluntarily changes the itinerary during the trip or does not travel according to the itinerary which forms an integral part of the contract with the travel agency Ride Goričko, it shall be deemed that the client has withdrawn from the contract during the trip. In this case, too, they have no right to a refund of costs or the purchase price, neither partially nor in full. In this event, however, the client is liable for the costs and damage caused to the organiser by the change of itinerary.
In the event of a programme change at the request of the client or due to force majeure, without reasons for this lying with the Ride Goričko travel agency, the client has no right to claim any compensation or price reduction.
After concluding the contract, the client or the tour organiser may, upon the client's request, change the name or the number of clients, the accommodation, or the travel date, provided that such a change is possible without cancelling the arrangement. The transfer to a third party is possible solely on the basis of a written notification or an e-mail notification by the client and at least seven days before the start of the package tour. For each such change, the Ride Goričko travel agency shall charge the client a reservation fee. However, in cases where the costs of the change are higher, particularly when the arrangement also includes charter transport or scheduled flight transport and costs are also incurred by providers due to cancellation and change, the Ride Goričko travel agency shall demand reimbursement of the actual costs incurred as a result of the change.
The client is entitled to a refund if the cancellation occurred due to: illness, accident or death of the client, the client's companion, or an immediate family member of the client or companion. The claim must be justified by a written doctor's letter.
In the event of a cancellation where the client is a company, institution, association or federation, the reason for cancellation is thoroughly checked. If it is established that the client is unable to attend, the client and the Ride Goričko travel agency shall agree on a new date with the same content as that agreed upon at the time of the first confirmed booking. Bad weather is not a reason for cancellation if the Ride Goričko travel agency can ensure the execution of the activity, programme or package for the client. If it is established that the cancellation is not justified, the Ride Goričko travel agency shall issue an invoice to the client in the same manner as for a completed service. For a new date, the client must confirm the newly mutually agreed date to the Ride Goričko travel agency within 5 working days from the day the Ride Goričko travel agency sent the newly mutually agreed date to the client in writing. If the client fails to confirm the newly agreed date within the agreed time, the Ride Goričko travel agency may release the newly offered date again and offer it to other clients.
To a company, institution, association or federation that cancels a booked activity, programme or package with the first booking date and fails to confirm in writing a second agreed date or cancels it again, the travel agency Ride Goričko shall send an invoice containing all agreed services in the originally booked reservation. The date of the written cancellation of the first booking serves as the basis for the preparation of the invoice.
In the event of cancellation by the client due to natural disasters, epidemics, pandemics, war or other force majeure beyond the control of the Ride Goričko travel agency, the Ride Goričko travel agency shall under no circumstances refund the money paid, but shall instead agree with the client on a new date for the activity, programme or package within a maximum of two years from the time when the cause of the cancellation has ceased to exist.
In accordance with applicable legislation, the travel agency Ride Goričko reserves the right to cancel a trip or activity, or to modify the travel or activity programme. The travel agency Ride Goričko reserves the right to cancel a trip or activity prior to the scheduled departure if the number of subscribers specified in the programme or travel contract fails to register, but no later than:
– 20 days before the start of the package tour for trips longer than six days;
– 7 days before the start of the package holiday for trips lasting from two to six days;
– 48 hours before the start of the tourist package for trips shorter than two days.
Unless otherwise stated in the programme or travel contract, the minimum number of subscribers for a given means of transport is as follows:
– for bus travel – at least 40 subscribers per bus;
– for travel on scheduled airline routes in Europe – at least 20 passengers in an individual group;
– for travel on intercontinental flight routes – at least 15 subscribers in an individual group;
– for travel on special aircraft, trains or hydrofoils – a minimum occupancy rate of 80 %.
In cases where the Ride Goričko travel agency explicitly guarantees departure in writing, it cannot cancel the trip, except in the event of force majeure. The Ride Goričko travel agency reserves the right to fully or partially withdraw from the contract if, before or during the implementation of the programme, extraordinary circumstances arise that could not have been anticipated, eliminated, or avoided, and for the Ride Goričko travel agency these circumstances represent a justified reason not to have concluded the contract had they existed at the time of its conclusion.
Neither of the contracting parties shall be liable for any breach of the travel contract if the inability to fulfil the contractual obligations or individual provisions thereof is the result of unforeseen, unexpected and unavoidable events, commonly known as force majeure, or measures taken by the state or other competent administrative authorities, as well as acts of third parties which are beyond the control of the parties and which the parties could not have anticipated, prevented or averted. The Ride Goričko travel agency shall not be liable to the client for any damage incurred by the client under the travel contract due to force majeure.
For tour packages and other tourism services where suitable weather is an essential condition for fulfilling the itinerary, cancellation of the contract due to poor or unsuitable weather shall be deemed a cancellation due to extraordinary circumstances. In this case, the client is only entitled to a refund of the amount paid or to the transfer of the paid amount to another date.
The Ride Goričko travel agency may withdraw from the contract and claim compensation for damages from the client who directly breaches the provisions of the contract concluded with the Ride Goričko travel agency, particularly if it is established that the client intentionally provided incorrect information regarding the number of clients or their age, or if changes occurred during the trip and the client failed to inform the Ride Goričko travel agency thereof.
Ride Goričko travel agency reserves the right to change the day and time of departure or to cancel the trip due to a change in the flight schedule or the occurrence of force majeure, as well as the right to change the itinerary if travel conditions change (new timetable, uncertain situation in the country where the programme is organised, natural disasters, or other unforeseen causes beyond the control of the Ride Goričko travel agency), without special compensation and in accordance with applicable passenger transport regulations.
The Ride Goričko travel agency must immediately notify the client of such a change, and the client must confirm the change in writing.
The travel agency Ride Goričko accepts no responsibility for programme changes due to the occurrence of any force majeure during the trip or activity. In such cases, it may provide clients with services in an altered form, depending on the circumstances.
In the event that the travel agency Ride Goričko cancels the trip, the client is entitled to a full refund of the paid tour price. In the event of the cancellation of the trip or activity by the travel agency Ride Goričko, the client has no right to a refund of the costs of a visa required for entry into the country to which the trip was scheduled, or the costs of vaccinations required by the programme. The travel agency Ride Goričko shall notify the client immediately of any subsequent changes to the programme. If the travel agency Ride Goričko or another tour operator withdraws from the contract during its performance, it has the right to payment of the full purchase price for the travel arrangement. The client has no right to a refund of booking fees, nor to a refund of the payment for trip cancellation insurance taken out with an insurance company, or the refund of a cancellation fee payment.
The travel agency Ride Goričko shall not be held liable for delays of flights, ships or trains, nor for programme changes resulting from such delays. If, due to extraordinary circumstances that could not have been foreseen, avoided or averted, the travel agency Ride Goričko is unable to provide the clients with accommodation in the agreed establishment on-site, it may accommodate the clients in an establishment of the same or a higher category and solely in the agreed location.
In accordance with item 6 of Article 57b of the Consumer Protection Act (ZVPot), the Ride Goričko travel agency is obliged to inform the client about the applicable passport, visa, foreign exchange, customs and health regulations in force in the destination country.
The client is responsible for ensuring that they personally, as well as their documents and luggage, comply with the requirements laid down by the border, customs, health, and other regulations of the country from which they are travelling, as well as those applicable in the country to or through which they are travelling.
A client who books travel abroad must hold a valid passport or other suitable valid identity document required to enter the respective country. In the event that individual countries make entry conditional on a specific period of validity of the travel document prior to its expiry date on the day of entry, the Ride Goričko travel agency is obliged to draw the client's attention to these provisions, but if the client fails to heed these warnings, they shall bear sole responsibility for any inconveniences or forced interruption of the trip.
The client is required to obtain visas for the countries they are travelling to before the trip or by the deadline specified in the programme, and to undergo the vaccinations required for these countries.
If the client fails to fulfil these obligations, Ride Goričko may act in accordance with the provisions of these general terms and conditions and the instructions regarding the client's cancellation of travel (point 9). In the event that the client's visa is arranged by the Ride Goričko travel agency, the latter does not guarantee the successful acquisition of the visa. The Ride Goričko travel agency shall under no circumstances refund the costs of processing and obtaining visas to the client. The Ride Goričko travel agency does not guarantee the accuracy of information obtained from the competent embassies. In the event of refusal of entry into the country or other obstacles, all costs shall be borne by the client alone. The mediation of the Ride Goričko travel agency in obtaining a visa is not included in the travel price, but is paid separately. The client shall be deemed to be arranging the visa themselves if they do not deliver the documents required for arranging the visa to the Ride Goričko travel agency within the deadline specified in the programme or offer.
Due to the requirements of international passenger transport (air, sea, bus, etc.), the client is obliged, when booking a tour package or activity, to provide the Ride Goričko travel agency with all the necessary details regarding all participants for whom they are booking the trip. The details must match the information in official documents completely and accurately, which clients are required by state border-crossing regulations and relevant foreign legislation to carry with them at all times. In the event that the client provides the Ride Goričko travel agency with incorrect or inaccurate information and this causes a delay, additional costs or the interruption of the trip, the client shall bear all resulting costs themselves.
The client is obliged to observe the house rules in catering and hotel establishments and to cooperate in good faith with the organiser's representative and the service provider. If the client fails to comply with their obligations, they shall be liable to the organiser for any damage caused, and the organiser shall not be liable for any damage that the client may suffer in such a case. During the trip, the client is obliged to behave in such a way as not to endanger the life or health of fellow travellers and not to jeopardise the course of the trip itself. In the event that the client behaves contrary to this provision, the organiser's representative has the right to exclude them from the remainder of the trip without any refund of costs, except for the return of paid and unused amounts for potential entrance fees, etc., which are paid on the spot. In the event that, due to the client's inappropriate conduct or behaviour, they wish to use the services of the Ride Goričko travel agency, e.g. due to premature return to the place where the trip started, etc., payment for such services shall be borne by the client. The Ride Goričko travel agency may also charge an appropriate fee for the services performed.
Ride Goričko travel agency does not send pre-travel notices to clients by standard post, unless otherwise specified in the programme. Clients receive the pre-travel notice at their email address. The email address hello@ridegoricko.com and telephone number 00386 41 877 807 are also available to clients.
In the event that the client does not receive a notification at their email address up to three (3) days before departure, the travel agency Ride Goričko kindly asks them to contact the above-mentioned email address and/or telephone number.
The client shall bear any damage resulting from the client providing the Ride Goričko travel agency with an incomplete or incorrect address (postal and/or electronic) for the purpose of fulfilling an order form, referral, voucher, contract, and/or notice.
Based on World Health Organisation regulations, the client is required to be vaccinated prior to travelling to certain countries and to obtain appropriate proof for this purpose. Vaccination is mandatory even if such a regulation is adopted after the travel contract has been concluded. The fact that vaccination is required after the conclusion of the travel contract is not a justifiable reason for the client to withdraw from the contract, unless there could be adverse consequences for the client's health as a result of the vaccination. In such a case, the client is obliged to provide a medical certificate. In the event that certain vaccinations are listed or required in the travel itinerary, each client must personally obtain an international certificate – a yellow booklet – with the completed vaccinations recorded in it.
Ride Goričko travel agency shall not be held liable for any potential complications, or for the client's cancellation of travel or activities resulting from the client's failure to comply with the health regulations of the country being entered or the programme they have signed up for, nor for any associated costs.
The organiser, agent or intermediary is not responsible for the transport of luggage; they are not liable for destroyed or lost luggage, nor for the theft of luggage and/or other valuables in the hotel or other accommodations.
The client shall submit any claim for lost or damaged luggage directly to the carrier, hotel, or other direct service provider. For the carriage of special luggage, such as a bicycle, surfboard, golf equipment, etc., the client must pay a surcharge to the carrier, usually upon departure directly at the airport. In any case, the carriage of such luggage must be requested at the time of booking the trip, and the airline nevertheless reserves the right to refuse the carriage of such luggage due to capacity limitations. All resulting costs or damages shall be borne solely by the client.
Ride Goričko travel agency shall not be held liable for the theft of or damage to the client's luggage or other personal belongings, valuables and documents from accommodation establishments (hotel rooms, apartments, etc.) and means of transport (aeroplanes, buses, ships, etc.).
The travel agency Ride Goričko accepts no liability for the punctuality of land, sea and air transport when operated by public means of transport, on scheduled or unscheduled passenger services, sailings or flights. The liability of the carriers is duly defined in the contract between the client and the carrier, which comes into effect upon use of the means of transport. The travel agency Ride Goričko accepts no liability for damage arising from delays, cancellations or changes to transport or the means of transport.
Ride Goričko travel agency reserves the right to change the timetable, aircraft types, carrier and flight route (intermediate stops, flights via another airport, etc.) arising from various technical and organisational reasons on the part of the carriers. Delays may also occur, which are most frequently the result of airspace congestion, strikes and bad weather, and over which the organiser has no control.
Modifications from the previous paragraph regarding package travel arrangements shall not be considered a change to the travel itinerary, as the first and last days of the trip are intended exclusively for arrival at and departure from the destination and the associated transport, rather than for relaxation.
The client is required to check the return time with the organiser's representative 48 hours prior to the return, unless travelling in a group with a tourist agency Ride Goričko guide.
If the client loses their documents during the trip or they are stolen, and the documents are urgently needed to continue the trip or to return to their home country, the client shall obtain new ones at their own expense.
When dealing with these formalities, the client may turn for advice and assistance to the tour leader or representative of the Ride Goričko travel agency, or to the representative of the tour operator organising the client's holiday package.
In the event that the client has to interrupt the journey due to the loss or theft of documents, they are not entitled to a refund of the price of the holiday package or reimbursement of expenses.
Information received by the client at the booking office is no more binding on the travel agency Ride Goričko than the statements in the programme or offer. In the event of doubt, the following shall always be deemed valid: a written offer, written information or a written explanation.
The average diligence of a customer who orders their services via the internet or telephone sales, and is therefore skilled in using such services, is to obtain all information important to them themselves via the websites of the accommodation establishment or holiday destination.
INSTRUCTIONS and SPECIAL CONDITIONS as well as USEFUL INFORMATION published in catalogues and/or price lists apply to all arrangements or activities, for both group and individual departures, for scheduled and specially prepared programmes, unless otherwise stated therein, and reserved services, and form an integral part of these general terms and conditions and instructions.
Photographs published on the internet and in promotional materials are for information purposes only, and therefore the Ride Goričko travel agency does not guarantee the completeness or authenticity of the information and appearance when such a guarantee is not explicitly stated.
Accommodation in the programmes is classified in accordance with the official national categorisation of the individual countries valid at the time of publication of the programme, over which the organiser has no influence. The standards of tourist services among the chosen destinations vary and are incomparable. It should be borne in mind that the categorisation criteria in some tourist destinations differ significantly from those applicable in the Republic of Slovenia or in most Western European countries, and therefore the booking of higher-category accommodation is recommended in these countries.
Ride Goričko travel agency accepts no responsibility for any written or verbal information provided by an authorised agency of the Ride Goričko travel agency that is not in accordance with the descriptions of services in its programme.
House rules, catering, services, beach, as well as the rest of the hotel's offer are under the supervision of local tourist organisations. The organiser also has no influence whatsoever on these elements.
For packages marked as “all inclusive”, it is necessary to read the description of services in the programme or offer carefully, as not all »all inclusive« offers are the same. Usually, the basic service in an »all inclusive« offer is full board (breakfast, lunch and dinner), with drinks (local) included with meals.
If the client does not pay the extra charge for a room with special features (sea view, balcony, location – orientation, specific floor) at the time of booking, they will be accommodated in one of the rooms officially registered for guest accommodation in the hotel. Room allocation is the responsibility of the hoteliers; the tour operator has no influence over this, and although they can pass on the client's preferences, they cannot guarantee that these will be fulfilled. When staying in a single room, the client must bear in mind that it generally does not meet the standard of a double room, is usually smaller, and may have a less favourable location. When staying in a triple room, the client must take into account that this is most often actually a double room with an extra bed, whereby the accommodation of the third person does not meet the accommodation standard of the other two persons. This is usually a fold-out bed, which is not equal in size and comfort to a normal bed and is suitable for children.
The client must complain about any irregularities or deficiencies on the spot, to the tour leader, the representative of the travel agency Ride Goričko, or the representative of the tour operator organising the client's tourist arrangement or activity, the direct service provider, or the authorised local agency. In the event that the complaint could, by its nature, have been resolved on the spot (for example, inadequate room cleanliness, equipment, room location, etc.), and the client failed to complain about the defect on the spot and did not notify the aforementioned persons of the irregularity, it shall be deemed that the client agreed to the service performed in such a manner.
Appeals procedureThe client must complain about an inadequate service immediately on the spot to the organiser's representative, or in their absence, to the service provider. The client must cooperate with the representative in good faith to eliminate the cause of the complaint. If the client does not accept the offered resolution of the complaint, which corresponds to the services paid for under the programme, the travel agency Ride Goričko will not consider any subsequent claims for damages or a reduction in the price of the trip. If the cause of the complaint cannot be eliminated, the client shall draw up a written report with the representative. Upon returning from the trip, the client must, within the statutory period of two years from the end of the trip, send a written complaint by registered mail to the address: Ride Goričko, Peter Gomboc s.p., Večeslavci 126, 9262 Rogašovci, and enclose evidence proving the justification of the complaint (mandatory written confirmation bearing the signature of the representative or service provider, any receipts for additional costs, etc.). The organiser is obliged to provide a first written reply to the client within 8 days of receiving the complaint, and a final reply within a reasonable time necessary to obtain information regarding the cause of the complaint from the service provider, or within the time necessary to obtain information from third parties in accordance with Article 892 of the Code of Obligations. Until the organiser issues a reply to the client's complaint, the client waives the right to pass the complaint on to third parties and competent institutions or to provide information to the media and other publics.
The organiser will only resolve complaints where the cause could not be remedied on the spot. In the event of a complaint regarding a trip for which the Ride Goričko travel agency is not the tour operator, the Ride Goričko travel agency will forward the complaint to the responsible tour operator and notify the client in writing of the complaint's resolution. Foreign organisers have a shorter time limit for submitting complaints, namely 30 days, and therefore the client must send the complaint as soon as possible. In the event that the Ride Goričko travel agency acts solely in the capacity of an information provider, the client must assert all claims arising from the complaint on the spot with the actual organiser of the additional excursion, sightseeing tour, etc. Without a written complaint, the Ride Goričko travel agency will not consider claims for price reductions, damages, or other claims.
The complaint must be signed and can be submitted by any subscriber themselves in their own name, or they may authorise a third party in writing to do so. The authorisation must be attached to the complaint, otherwise the travel agency Ride Goričko will not consider such a complaint. Likewise, the travel agency Ride Goričko will not consider complaints that are not sent to the above-mentioned address. Complaints may also be sent via email exclusively to the email address hello@ridegoricko.com, but they must contain everything that complaints sent by post are required to contain.
The complaint must be well-founded. The customer should therefore attach appropriate evidence and/or a suitable certificate from the hotelier or accommodation provider, carrier, or other relevant person regarding the actual situation on the basis of which the customer is asserting their claim.
In accordance with Article 894 of the Code of Obligations and on the basis of Article 57f(b) of the Consumer Protection Act (ZVPot), the maximum compensation shall be limited to three times the total price amount. The client has the right to compensation in the amount of the real value of the unperformed services. This provision shall not apply in the event that the Ride Goričko travel agency has the right to cancel the arrangement or amend the programme in accordance with the provisions of these general terms and conditions and the law. The limitation of liability shall apply to all trips or activities for which a travel contract has been concluded. The client is not entitled to compensation for loss of profit or to the reimbursement of non-material damage and costs arising therefrom.
The travel agency Ride Goričko protects the personal data obtained from clients in accordance with all regulations in the field of personal data protection and free movement of data, and is committed to the highest standards of ensuring the protection of individuals' rights. The travel agency Ride Goričko primarily processes personal data for the purpose of concluding or fulfilling a contract, but may also process it for the purposes of direct marketing and informing about the offers of the travel agency Ride Goričko or its partners, market research, conducting business analyses, customer segmentation, and statistical processing. It does not pass on data to third parties unless there is a legal basis provided for by law.
Personal data may be processed on the basis of law, on the basis of a contractual relationship if it concerns personal data required for the fulfilment of contractual obligations or the enforcement of rights arising from the contractual relationship, for the legitimate interests pursued by the controller or a third party, if this is necessary to protect the vital interests of the data subject or another natural person, and on the basis of the explicit consent of the individual for the processing of personal data given in accordance with regulations in the field of personal data protection and free movement. The consent given by the subscriber for processing may be changed or withdrawn in full at any time.
The client has at least the following rights:
right of access to data;
right to rectification;
right to erasure (the »right to be forgotten«);
right to restriction of processing;
the right to data portability;
the right to object.

With the aim of ensuring the highest possible standard of personal data protection for subscribers, the Ride Goričko travel agency has adopted a special Personal Data Protection Policy, which is an integral part of the General Terms and Conditions and Instructions and is available at www.ridegoricko.com.
The participant agrees that the travel agency Ride Goričko may use and reproduce any photographs or videos that the participant sends to us or that are taken by our guides or other participants, individually or in a group, in any medium or on the internet, free of charge and without your right of review, for the worldwide promotion and publication of our travel products and services. If you do not want us to use your images taken by us or other participants during the trip, you must notify us or your tour or activity leader in writing prior to the start. Participants who provide us with their photographs waive their copyright and agree to their use for commercial purposes.

In the event of a dispute between the parties, the court in Murska Sobota shall have jurisdiction.
These general terms and conditions apply to all contracts concluded from the date of publication of these terms and conditions on the website https://www.ridegoricko.com.
If the desired, booked and paid tourist package is based on accommodation in apartment buildings or individual apartments, check-in to the apartments is possible from 16:00 on the start date of the individual package, or unless otherwise stated in the booking confirmation. On the last day of the individual package, the apartment must be vacated by 10:00, or unless otherwise stated in the booking confirmation.
In the case of an individual booking for tour arrangements or travel, the client may, pursuant to the provisions of the second paragraph of Section 6 of these general terms and conditions and instructions for tour arrangements, allow the travel agency Ride Goričko to assist them in finding a co-traveller on the same tour arrangement with whom they will share a room, or is willing to share a room with them. Notwithstanding the aforementioned, an individually booking client must pay the single room supplement at the time of booking, in the event that the travel agency Ride Goričko is unsuccessful in finding such a co-traveller for the individually booking client.
In the event that an individually registered subscriber is matched with a co-subscriber in accordance with the first paragraph of this point, such a subscriber shall be refunded the single room accommodation surcharge or the surcharge shall be deducted from the final payment for the trip. If such a subscriber and co-subscriber (as stated in the preceding two paragraphs) discover during the course of the trip that they nevertheless wish to be accommodated in separate single rooms, this shall be permitted only if it is possible on site, subject to the availability of capacity. The costs shall be borne equally by both subscribers, each paying half.
In cases where the travel agency Ride Goričko is not the tour operator, it acts as an intermediary. In such cases, it provides the client with information received from the tour operator and assists them with booking the trip. The conditions for registration, payment of the registration fee and final payment (deadlines), as well as any cancellation of the trip, are in accordance with the applicable terms and conditions of the other tour operator. Such programmes are specially marked, and the appropriate indication is also given on the travel confirmation. It is deemed that the travel agency Ride Goričko sells such arrangements in the name and for the account of a third party. Any complaints shall be handled by the tour operator.
In the case of a contract for a linked travel arrangement (that is, an arrangement containing at least two different types of travel service purchased for the purpose of the same trip or holiday, which does not constitute a package holiday), the consumer cannot assert rights that belong to them in the event of concluding a package travel contract and which are not provided for in the contract. In this case, each provider is individually responsible for the performance of the service.
In the case of telephone sales of holiday packages, the contract is deemed to be concluded:
In this case, the client is required to pay for the ordered service based on the reservation number within 3 days of making the booking, unless a longer or shorter period is specified or agreed. If the client fails to pay within this period, the contract shall be deemed not to have been concluded.
It is considered that the client accepted the provisions of these general terms and conditions and the offer the moment they ordered the tourist package by phone.
In the event of concluding a package travel contract away from business premises, the customer has the right to withdraw from the contract within 14 days without giving any reason.
In the event of booking or purchasing a holiday package via the internet, these general terms and conditions and instructions for holiday packages, as well as these special terms and conditions of business and the offer published on the website of the travel agency Ride Goričko or the website of the intermediary of the travel agency Ride Goričko, shall apply.
In the event that the provisions of these general terms and conditions and instructions for tourist packages and the provisions of the special conditions or the offer published on the website conflict, the provisions published on the website shall prevail.
It is considered that the client accepts the provisions of these general terms and conditions and instructions at the very moment they order an individual service of the Ride Goričko travel agency via the website.
In the event of concluding a package travel contract away from business premises, the customer has the right to withdraw from the contract within 14 days without giving any reason.
In individual cases specified by a particular holiday package programme, it may be provided that minor children up to the age specified by that same programme, travelling accompanied by two adults, are granted discounts on individual services within the overall holiday package or on the holiday package as a whole.
The conditions and amount of each discount are specified in each individual tour package programme. If the individual programme does not provide for special discounts for minors travelling accompanied by adults, it means that this tour package does not provide for such special discounts.
Every child, regardless of age and the amount of any potential discounts, must be listed on the travel document and must possess valid documents required for eventual entry into foreign countries to which they are travelling. In the event that a child is not listed on the travel document or voucher for the individual holiday package, it shall be deemed that the child has no right to travel as part of that holiday package.
Last-minute travel or a „last minute“ package means that these are the final available tourism packages. The organiser occasionally also has the option to offer specially marked lower-priced packages, where the name of the hotel is not necessarily known at the time of concluding the contract.
This means that the name of the property is not yet specified in the travel contract. For these arrangements, the organiser guarantees the information that is stated in the contract, which includes at least: the category of the property (according to the official national categorisation), the room type, the hotel service (overnight stay, half board, all inclusive, etc.) and the place of accommodation. For these arrangements, the client will be informed of the name of the accommodation property no later than with the departure documents.
On all scheduled coach tours, the organiser determines the seating plan according to the order in which clients book. Seat numbers may be positioned very differently on individual coaches. Some coaches also do not have numbered seats, in which case clients are seated on the coach by the organiser's tour leader. However, the seating plan on coach tours organised within Europe by air, and on all intercontinental tours, is determined only in cases where this is possible and appropriate given the size of the group, the itinerary and the manner in which the tour is conducted. The organiser reserves the right to change the seating plan in cases where, due to a lower number of registered clients, clients are combined from the originally planned two or more coaches into a smaller number of coaches.
If any of the persons travelling abroad organised by the Ride Goričko travel agency are under 18 years of age at the time of the trip, they are required to bring along at departure a correctly completed certificate or statement by which the parents or guardians of the minor consent to the minor travelling organised by the Ride Goričko travel agency at their own responsibility or at the responsibility of the parents or guardians. In the event that the minor does not have this certificate with them, they cannot travel with the Ride Goričko travel agency, and the Ride Goričko travel agency reserves the right to turn them away before departure without special compensation.
Gift vouchers are available at the Ride Goričko travel agency. All gift vouchers are valid from the date of issue until the date stated on the voucher. The Ride Goričko travel agency shall not be held liable for any claim in the event of theft or any other misappropriation of the gift voucher. The voucher cannot be exchanged for cash under any circumstances. Copying or otherwise reproducing gift vouchers is strictly prohibited and unlawful. Only original gift vouchers of the Ride Goričko travel agency containing original signatures, stamps and other easily verifiable elements shall be valid.

Definition of terms
The organiser of the prize games on the Facebook (ridegoricko) and Instagram (ride_goricko) pages is the tourist agency Ride Goričko, Peter Gomboc s.p., Večeslavci 126, 9262 Rogašovci. A participant in the prize game is a natural person who takes part in the announced prize campaigns. The winner of the prize game is determined by a random draw.
Participants in the prize draw may be adult natural persons who are citizens of the Republic of Slovenia. Persons employed by the organiser of the prize draw and their immediate family members, as well as persons employed by other legal entities connected with the implementation of this prize draw, may not participate in the prize draw. Legal entities cannot be participants in the prize draw. Persons who do not accept the rules of the prize draw may not participate. A participant is deemed to have accepted the rules of the prize draw by participating in the announced prize draw.
No purchase of the organiser's services or products is required to participate in the prize draw.
All participants of the prize game who fulfil all the conditions for participation may take part in the draw. Each participant may only participate in the prize draw once. The result of the draw is final. No appeals are possible. The winner will be notified of winning and the method of collecting the prize by email or via a Facebook or Instagram message.
Cash payment of the prize is not possible, nor can it be exchanged for another service. The winner is obliged to provide the competition organiser with their personal details in writing (e-mail) – first name, surname, address, e-mail address, telephone number and tax number, all within no later than two days of receiving notification that they have won the prize. If the winner fails to fulfil all obligations, it shall be deemed that the winner does not wish to accept the prize, and the organiser is thus released from all obligations towards the winner under this competition and acquires the right to dispose of the prize for any other purpose. Prizes are not transferable. If the organiser of the competition does not receive all the necessary data and the statement that they wish to receive the prize within three (3) working days from the moment they send the notification to the winner that they have been drawn, for any reason whatsoever (e.g.: the winner states that they do not wish to accept the prize, the address or e-mail address is incomplete or incorrect, etc.), it shall be deemed that the winner does not wish to accept the prize, and the organiser is thus released from all obligations towards the winner under this competition and acquires the right to dispose of the prize for any other purpose.
The organisers and persons participating in the implementation of the prize competition shall not be liable for any damage arising from the prizes. The organiser accepts no liability for any undesired consequences suffered by participants and/or any third parties as a result of participating in the prize competition or as a result of using the prize.
Personal data protection
The organiser of the competition collects only the winner's personal data for the purpose of dispatching the prize and keeping records of competition winners. By participating in the competition, the drawn winner consents to their name and address being used in audio, photo and video material of the competition organiser. The drawn winner consents to the competition organiser publishing their personal data in the mass media and on the worldwide web for the purpose of notifying about the draw results or the collection of the prize.
By participating in the competition, participants agree that they are familiar with the rules and undertake to act in accordance with the rules of the competition. In the event of any dispute or ambiguity, these rules shall prevail over any other publications, whether in printed, electronic or any other form.
